Terms & conditions

These terms govern all purchases made through elartedelcomic.com and through the gallery directly. They are written to be read by humans first.

1 — Who we are

2 — Originality of the work

All pieces sold are described as either original art (one of one — the unique, hand-executed source artwork) or as a numbered/signed print or facsimile, in which case the description and the catalogue page state so explicitly. Where a piece is sold as original, the gallery guarantees its originality and provides a Certificate of Authenticity that is the contractual basis of that guarantee.

3 — Price, payment, taxes

All prices on the site are shown in euros. For shipments within the European Union, prices include VAT at the applicable rate. For shipments outside the EU, prices are shown net of VAT and may be subject to customs duties on arrival.

4 — Right of withdrawal

Private EU consumers are entitled to a 14-day withdrawal period as described on the Shipping & returns page.

5 — Intellectual property

The intellectual property in the artworks themselves remains with the artists or their assignees in all cases. Buying an original page does not transfer reproduction rights. The gallery's photographs of pieces, the site copy, and the gallery's curated text are © El Arte del Cómic.

6 — Liability

Our liability for any single transaction is capped at the sale price of the piece in question. Nothing in these terms limits liability that cannot be limited under Spanish law, including in case of fraud or wilful misconduct.

7 — Governing law

These terms are governed by Spanish law. Disputes will be resolved by the courts of Madrid, without prejudice to any consumer rights that direct disputes to the consumer's court of habitual residence.
